Floridaโ€™s inland communities were hit hardest by Hurricane Milton in August 2024, with floodwaters lingering for three weeks in neighborhoods along the Iโ€‘4 corridor, Polk County Commissioner Becky Troutman said, after residents watched their streets turn into rivers. The storm, which dumped more than 15 inches of rain in parts of central Florida, left thousands without power and caused an estimated $1.2โ€ฏbillion in damage across the state, according to the Florida Division of Emergency Management.

The disaster underscores a growing tension between stateโ€‘level preemption laws and local efforts to manage climate risk. Since 2022, the Florida legislature has passed a series of bills that limit municipalitiesโ€™ ability to adopt stricter building codes, floodโ€‘plain regulations, and environmental protections, arguing that uniform rules protect property owners and businesses. Those laws also curtail local authority over worker safety standards and minimumโ€‘wage increases, tying city and county hands when they try to address the unique hazards their residents face. Critics say the restrictions leave fastโ€‘growing areas like Polk County vulnerable, as rapid development along Iโ€‘4 has expanded impervious surfaces and strained aging drainage systems.

Local officials say the prolonged flooding after Milton was a direct result of those constraints. โ€œWe couldnโ€™t raise our own standards for stormโ€‘water management or require higher elevation for new homes because the state has taken that power away,โ€ Troutman explained. The countyโ€™s emergency manager reported that 2,300 homes were flooded, with 12โ€ฏpercent of residents filing insurance claims exceeding $10,000 each. Environmental groups have filed a lawsuit challenging the preemption measures, arguing they violate the state constitutionโ€™s provision for local selfโ€‘governance and endanger public safety.

State lawmakers face mounting pressure as climate events become more frequent. The Florida Senateโ€™s climate committee is scheduled to hear testimony from county leaders next month, and Governor Ron DeSantis has signaled openness to โ€œtargetedโ€ adjustments that would allow localities to address extreme flooding without overturning the broader preemption agenda. Meanwhile, federal agencies are reviewing disaster assistance eligibility, which could provide additional funding for infrastructure upgrades if localities regain some regulatory flexibility. The outcome will shape how Florida balances uniform business rules with the need for localized climate resilience.
