Sports betting in the United States has expanded dramatically since the 2018 Supreme Court ruling that struck down the federal ban on stateโ€‘licensed sportsbooks. Kalshi, launched in 2020 and overseen by the Securities and Exchange Commission, allows users to buy and sell contracts that pay out based on the outcome of events, including sporting events. Several states have argued that allowing sports betting on Kalshi would undermine their regulatory frameworks, dilute consumer protections, and erode the revenue stream that comes from stateโ€‘licensed sportsbooks. Kalshi counters that its platform is subject to federal securities law and that state bans would create a patchwork of restrictions that stifle innovation.

The legal battle began when the Ninth Circuit ruled that a California law banning sports betting on Kalshi was unconstitutional, while the Eleventh Circuit upheld a similar ban in Alabama. Kalshi has filed a petition for certiorari, asking the Supreme Court to resolve the split. In its brief, the company argues that the federal securities framework provides sufficient consumer safeguards and that state bans interfere with interstate commerce. State officials, on the other hand, claim that the Supreme Court has a long history of allowing states to regulate gambling to protect residents and to maintain control over local betting markets. The courtโ€™s docket now includes the petition, and the decision could arrive as early as the next term.

If the Supreme Court sides with Kalshi, states would lose a tool to curb sportsโ€‘betting on prediction markets, potentially expanding the industryโ€™s reach and increasing consumer exposure. A ruling in favor of the states would reinforce the idea that state governments retain the authority to regulate gambling even when the activity is conducted on a national platform.
